Introduction

Visier values your trust and respects your privacy. We take our privacy obligations seriously and are committed to being proactive and transparent about our information handling practices.

This Privacy Statement explains how we collect and handle information in connection with our Services and outlines your choices regarding our collection, retention, and processing of your information. Additional information on our privacy practices is provided in supplemental privacy notices provided prior to, or at the time of information collection. Visier applies the same Privacy Statement worldwide. We provide a courtesy translation in French, German, Portuguese, European Spanish and LA Spanish to best serve our customers. If any discrepancies exist, the English version will prevail.

Terms Used in this Privacy Statement

“App” means a Visier mobile application that interfaces with the Service Platform.

“Customer Data” means the data we process in the Service Platform as governed by a Subscription Agreement.

“Frameworks” means the EU-U.S. Data Privacy Framework, the UK Extension to the EU-U.S. Data Privacy Framework, and the Swiss-U.S. Data Privacy Framework.

“Service Platform” means the Visier service platform.

“Services” means the Sites, the App and the Service Platform and any other interaction you may have with us (for example, by attending our events).

“Sites” means the Visier website located at www.visier.com and other web pages we operate in which we post a direct link to this statement.

“Subscription Agreement” means a separate agreement governing access to and use of the Service Platform by a third party and its authorized users.

“Visier” means Visier, Inc. and its subsidiaries. The term “we”, “us”, and “our” also refer to Visier.

Information We Collect

We collect information when you visit and use our website, products and services, or otherwise interact with us. Depending on your relationship with us, we collect information in the following ways:

Information you provide through support channels

Our Services include customer support in which you may provide us information regarding a problem you are experiencing with our Services. When you open a support ticket, speak to one of our team members, or engage with our support team, you will be asked to provide contact information, a summary of the problem, and relevant documentation, screenshots or information for purposes of resolving the issue.

Recruitment information

You may provide us with information in connection with a job application or inquiry. See our Visier Candidate Privacy Notice at https://www.visier.com/candidate-privacy-notice.

Registration information

We collect your information such as name, email address and phone number when you register for our events, forums, or webinars. We may also collect relevant health and safety information.

Payment information

We may collect billing information when you register for our events, when you register for training, or when making purchases on our Sites.

Additional information provided to Visier

We receive other information when you submit content to our Sites (e.g. contact us), when you download our newsletters, when you indicate that you would like to receive any of our Services, when you visit our offices, when you speak to us over the phone, when you participate in surveys or focus groups, when you provide a testimonial, and when you interact with our branded social media accounts.

User input

We may collect information (i.e. the content of natural language questions) when inputted into a prompt as part of our Services.

‘Special category’ data

We do not collect information that is particularly sensitive (e.g. genetic data, biometric data, racial or ethnic origin, religion) unless it is volunteered by you.

Sensitive information we may collect include food allergies or dietary requirements which can imply or suggest your religion, health, or mobility requirements. Such sensitive data is only shared within Visier or with our third-party service providers acting as data processors for the purpose of providing the services you request and will not be shared or used for any other purposes.

Information We Collect Automatically

We use tools such as cookies, web beacons and similar technologies to automatically collect information from your computer or mobile device as you navigate through or use our Services.

Usage data

We collect information in connection with the use of the Service Platform by individual users. This includes Internet Protocol (IP) address, browser type, session ID, the features you use, the links you click on, login date and time stamps, content viewed or created, the requests you make, data related to your user input such as types of prompts, frequency of use and interaction time stamps, and other actions you take.

Device and browser information

We collect data from the device you use to access our Services such as IP address and browser type.

When you download and use our Services, we automatically collect information on the type of device you use, operating system version, and the device identifier (or “UDID”).

Log data

Our servers collect information when you access or use our Sites and record it in log files. This information includes IP address, the address of the web page visited, browser type and settings, operating system, login date and time stamp, information about browser configuration and plugins, language preferences, and cookie information.

Marketing information

If you choose to receive marketing emails or newsletters, we track whether you have opened these messages and whether you clicked on the links contained within these messages to better personalize future communications.

Social media features and widgets

Our Sites include social media features or widgets, such as Facebook Like or Share buttons. Use of these features may collect your IP address, the page you are visiting on our Sites, and may set a cookie to enable features to function properly.


Your interactions with these features are governed by the privacy notice of the third party providing these features.

Social media login data

For selected platforms, we provide you options to login using a third party social media account such as LinkedIn. If you choose to login this way, we collect the information described in the section Third Party Social Media Login Process below.

Cookies and similar technologies information

Cookies are small text files that are stored on your computer by your browser when you visit a website. We, or an authorized third party, may place cookies and similar technologies on your browser when you visit our Sites, use our Service Platform, or click on a link to be redirected to our Sites from a referring web page. We use both session-based and persistent cookies on our Sites. You can control the use of cookies at the individual browser level but choosing to disable cookies may limit your use of certain features of functions on our Sites. Mobile Analytics

We use mobile analytics software to allow us to better understand the functionality of our Apps. This software may record information such as how often you use the application, the events that occur within the application, usage, performance data, and where the application was downloaded from. We do not link the information we store within the analytics software to any information you submit within the App.

Information We Collect from Other Sources

We collect information about you from other sources, including third party providers of business contact information from whom we have purchased information, and combine this information with information provided by you. We use this information to update and analyze our records, identify new customers and create tailored marketing communications.

How We Use the Information We Collect

Information that Visier collects and receives is used for legitimate business interests or to comply with legal obligations including to:

Operate, maintain and improve our Services

This includes delivery of the Services under a Subscription Agreement; prevent or address service errors; monitor security or technical issues; analyze and monitor usage or trends; track aggregate traffic patterns throughout the Sites; measure and analyze user behavior; other activities upon a customer’s request; and to operate, maintain and improve our Services.

Communicate with you about the Services

This includes providing customer support; informing you about changes in our Services; sending important Services-related notices such as downtime or security alerts; announcements regarding new product features; and responding to your requests and questions. These are service-related communications and you may not opt out of them.

Send relevant marketing or promotional material

We use contact information to send you marketing and promotional communications or other Visier news that may be of interest to you. We combine information from third party sources with information we hold about you to help make our sales and marketing efforts more relevant to you, and to personalize and improve your experience. These are marketing messages and you can control whether you receive them.

Manage events and attendance

We use information to manage our events, track attendance, and obtain feedback to improve future events.

Engage through forums and surveys

We use contact details, comments and feedback to engage with our customers and partners in online forums and for conducting customer satisfaction, industry research, and post-training surveys. We use survey results to help improve products and services.

Enhance Services

We improve and enhance our Services based on customer feedback, historical use and interaction with AI tech systems such as predictive modelling and machine learning.

Manage security and authentication

We use contact details, identification information and CCTV footage for safety and security of Visier guests, staff and premises and login credentials for access to our network and digital assets.

Train and educate

We use contact details for the purpose of providing training and education for our customers and partners.

Testimonials

We display customer or user testimonials in our marketing materials with consent. If you wish to update or delete your testimonial, please contact us by email to marketing@visier.com.

Third party social media login process

For selected platforms we offer you the ability to login using your third party social media account details (such as Google or Linkedin). If you choose to link your account with us to a third party account, we use the information you allow us to collect from those third parties to facilitate the login process. This may include name and email address, and other information you choose to make public.

We do not control, and are not responsible for, other uses of your personal information by your third party social media provider. We encourage you to review their privacy notices to understand their privacy and information practices.

Manage accounts

We use your information to contact you for invoicing, account management and to keep track of billing and payments.

We may de-identify and aggregate your information with other information we collect for purposes of performing statistical and other data analysis.

Even when we may have a legitimate interest in processing your information, we will not do so if it overrides your interests, rights and freedoms.

How We Share and Disclose Information

We do not sell, share or otherwise disclose information we collect except as described in this Privacy Statement. We share information in the following ways:

Within Visier

We share information within the Visier group of companies for purposes of data processing and storage.

Third party service providers

We share information with third party service providers who have been appointed as data processors to perform functions and services on our behalf and who are provided only with information necessary to perform the services. Examples of these services include customer relationship management, payment processing, system monitoring, and the application of large language model (LLM) services such as natural language processing and content creation.

Service providers are not permitted to disclose information to others without our authorization or to use information for their own purposes.

Partner products or services

We partner with other companies to jointly offer products or services. If you purchase or specifically express interest in a jointly-offered product or service from us, we may share information we collect from you in connection with your purchase with our joint promotion partners. If you do not want us to share your information with these companies, please contact us at privacy@visier.com. We do not control our business partners’ use of your information which will be in accordance with their own privacy policies.

Law enforcement

We may be compelled to disclose information in response to a lawful request to meet national security or law enforcement requirements, as well as to protect the rights, property or safety of Visier, its business partners, you or others. This includes complying with court orders such as subpoenas, warrants, or other legal processes.

Merger, acquisition or sale

We reserve the right to transfer information in the event we are involved in a merger, acquisition, or sale of any or all assets. You will be notified by email or prominent notice on our website of change in ownership, uses of your information and choices you have regarding your information.

Visier Forums

You may post comments or questions on our websites or engage with Visier-facilitated events or discussions; for example, on a community forum, comments section, discussion forum, live or in-person sessions, or conversation workshops. Some of these forums allow you to provide your personal information and create a profile. Personal information you submit, post, or discuss in forums can be read, collected and used by others who access those forums.

International Data Transfers

Visier operates globally and transfers personal information to Visier in the U.S, to any Visier subsidiary, or to third parties and business partners that are located in countries around the world, including countries outside the European Economic Area (EEA). When you provide personal information to Visier, you consent to the processing and transfer of your information outside of your country of residence where data protection standards may be different. We comply with applicable data protection laws when transferring personal information and implement appropriate safeguards with respect to the protection of your privacy. For example, Visier utilizes the adequacy determinations made by the EC and the United Kingdom (UK) to transfer personal information to countries with data protection that is adequate to the EC and the UK. Personal information transferred outside the EEA to countries that the EC and the UK has not found to provide adequate protection will be protected by EC-approved Standard Contractual Clauses (SCCs) or other appropriate data transfer mechanisms, as required by law.

Visier Data Privacy Framework Notice

Visier complies with the EU-U.S. Data Privacy Framework (EU-U.S. DPF), the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (Swiss-U.S. DPF) as set forth by the U.S. Department of Commerce. Visier has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (EU-U.S. DPF Principles) with regard to the processing of personal data received from the European Union in reliance on the EU-U.S. DPF and from the United Kingdom (and Gibraltar) under the UK Extension to the EU-U.S. DPF. Visier has certified to the U.S. Department of Commerce that it adheres to the Swiss-U.S. Data Privacy Framework Principles (Swiss-U.S. DPF Principles) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the Principles shall govern. Visier is responsible for the processing of personal data it receives, under the DPF, and subsequently transfers to a third party acting as an agent on its behalf. Visier complies with the DPF Principles for all onward transfers of personal data from the EU, UK, and Switzerland, including the onward transfer liability provisions.

The Federal Trade Commission has jurisdiction over Visier compliance with the EU-U.S. DPF, the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. DPF. In certain situations, Visier may be required to disclose personal data in response to lawful requests by public authorities, including to meet national security or law enforcement requirements.

For complaints regarding DPF compliance not resolved by any of the available DPF mechanisms, you have the possibility, under certain conditions, to invoke binding arbitration. Further information can be found on the official DPF website.

How We Protect Information

In order to protect your information from unauthorized loss, or unauthorized use, access or disclosure, Visier employs reasonable and appropriate physical, technical and security safeguards to protect information. This includes the adoption of industry standard technical and organizational measures to secure the information we store. All systems used to support Visier’s Services are governed by Visier’s corporate security policies which are built upon industry standards and best practices such as the International Organisation for Standardization (ISO) 27001 family of standards and National Institute of Standards and Technology (NIST) standards.

Access to your information is restricted to authorized Visier employees and authorized third parties who need to know that information in order to process it for us and who are subject to strict confidentiality obligations.

The Services employ Secure Socket Layer (SSL) technology using both server authentication and data encryption. The Services are hosted in a secure server environment that uses firewalls, intrusion detection systems, and other advanced technology to protect against interference or access from outside intruders.

While Visier has implemented safeguards to protect your information, given the nature of communications and information processing technology, Visier cannot guarantee that your information is absolutely secure in all situations. It is your responsibility to ensure you are accessing the Services using an up-to-date web browser. You are also responsible for maintaining the security and confidentiality of any usernames and passwords associated with the Services.

For your own protection, we encourage you to not include personal information, credit card, or other sensitive information in any emails you send to us.

Keeping your information secure is our priority. We encourage responsible reporting of any vulnerability that may be found across our Services. To report a potential vulnerability or to make an enquiry about the security of our Services, please contact our Security team by email to security@visier.com.

How Long We Keep Information For

Visier retains information (including information we process on behalf of our Customers) for as long as needed to fulfill the purpose for which it is collected or as necessary to comply with legal obligations, resolve disputes, and enforce our agreements. Visier retains Customer Data according to the timeframes set forth in the Subscription Agreement or as otherwise authorized by our customers.

Information We Process on Behalf of Third Parties

Customers routinely provide Customer Data for processing in connection with our Service Platform. Visier does not share or distribute any Customer Data except as described in the contractual agreement between Visier and the customer, or as may be required by law. We process Customer Data in our Service Platform under the direction of our customers. Visier has no direct relationship with the individuals whose personal information is contained in the Customer Data. Our customer is the “data controller” with respect to its Customer Data and Visier is the “data processor”. The customer is responsible for providing all notices and fulfilling all requests associated with the collection and use of Customer Data.

If you believe that your information has been provided to Visier by one of our customers and you would no longer like to be contacted by that customer please contact the customer directly. As part of the services we provide to our customers, we may transfer their Customer Data (which may contain your information) to companies that help us provide our services. Transfers of this data to such third parties and any subsequent third parties are covered by the service agreements we maintain with our customers.

If you seek to access, correct, amend, or delete inaccurate information that is contained in Customer Data, you should direct your query to the Visier customer that provided Visier with the Customer Data (the data controller).

Your Privacy Rights and Choices

You may have rights relating to your information under privacy or data protection laws. Subject to verification of your identity, you may request access to and correction of, your information. Additionally, the following options are available to you, upon request, for the exercise of your rights:

  • Provide a description of the information we process about you;
  • Rectify or update inaccurate or incomplete information about you;
  • Delete or request erasure of information about you (unless an exception applies);
  • Restrict the processing of information, in certain circumstances;
  • Withdraw your consent where you have previously given consent to process your information; and
  • Provide a copy of your information in a structured, commonly used and machine- readable format, in certain circumstances.

These options may be limited in some situations such as where we can demonstrate that we have a legal requirement or legitimate interest to process your information.

If you subscribe to our newsletter(s) or other marketing communications, you may choose to stop receiving those communications by using the unsubscribe link included in our emails or by contacting us by email to marketing@visier.com.

Children’s Privacy

In accordance with the U.S. Federal Children’s Online Privacy Protection Act (COPPA) and other applicable data protection laws, Visier does not knowingly collect personal information from any individual under the applicable age of consent without parental or guardian consent. If you believe that we may have collected personal information from someone under the applicable age of consent in your country without the proper consent, please contact us by email to privacy@visier.com and we will take action to investigate and delete such information.

Notice to End Users

Where the Services are made available to you through an organization (e.g. your employer), that organization is the administrator of the Services and is responsible for the accounts and/or Services over which it has control. Visier is not responsible for the privacy or security practices of an administrator’s organization.

There may be links to third-party websites and services that are outside our control and which are not covered by this Privacy Statement. The information practices and the content of such other websites are governed by the privacy statements of such other websites. We encourage you to review the privacy statements posted on those websites to understand their information practices.

Updates to this Privacy Statement

This Privacy Statement is updated from time to time to reflect changes in our Services, practices or technologies, and to comply with legal requirements. The most current version will be posted on our website. We encourage you to review this Privacy Statement to stay informed about our privacy practices. If the changes are significant, we will provide a more prominent notice on our website prior to the change becoming effective and indicate at the top when it was most recently updated.
